1. Introduction
These Terms & Conditions govern the sale, purchase, and import of new and used luxury vehicles by Fatima Corporation Sdn Bhd ("the Company"). By engaging in any transaction with the Company, the customer agrees to be bound by these Terms & Conditions.
2. Business Operations
2.1. Fatima Corporation Sdn Bhd operates as both a car dealership and an importer of new and used luxury vehicles from overseas for the Malaysian market.
2.2. The Company reserves the right to modify or discontinue any services or products without prior notice.
3. Vehicle Sales & Importation
3.1. All vehicles sold by the Company are subject to availability and may include both new and used models.
3.2. Imported vehicles are subject to customs clearance, import duties, taxes, and compliance with local regulations.
3.3. The Company ensures that all imported vehicles comply with relevant road-worthiness and safety standards before delivery.
3.4. The customer is responsible for ensuring that all necessary documents and approvals are obtained for vehicle registration and use in Malaysia.
4. Pricing & Payment
4.1. All prices quoted are in Malaysian Ringgit (MYR) and are subject to change without prior notice.
4.2. The final price of the vehicle includes applicable taxes, duties, registration fees, and other charges, unless otherwise stated.
4.3. Payment methods accepted: Cash, Credit/Debit Cards, Lease financing (subject to approval from financial institutions)
4.4. Full payment or a deposit amount agreed upon is required before vehicle delivery.
4.5. In the event of non-payment or payment failure, the Company reserves the right to cancel the transaction and retain any deposit paid as liquidated damages.
5. Delivery & Ownership Transfer
5.1. Vehicles will be delivered within the estimated time-frame provided at the time of purchase. However, delays due to customs clearance, shipping, or unforeseen circumstances may occur.
5.2. The Company is not liable for any delays beyond its control.
5.3. Ownership of the vehicle transfers to the customer upon full payment and successful registration with the relevant authorities.
5.4. The Company is not responsible for any damages or losses occurring after the vehicle has been delivered and registered under the customer’s name.
6. Warranty & After-Sales Service
6.1. New vehicles are covered under the manufacturer’s warranty. Used vehicles may be sold "as-is" or with limited warranty, depending on the terms stated at the time of purchase.
6.2. Warranty claims must be made in accordance with the terms and conditions provided by the manufacturer or warranty provider.
6.3. The Company offers after-sales service, which may include maintenance and repairs at additional costs.
7. Returns & Refunds
7.1. All vehicle sales are final. Refunds or exchanges will only be allowed under special circumstances at the sole discretion of the Company.
7.2. If a return is approved, any refund will be subject to deductions for administrative costs, depreciation, and applicable taxes.
8. Dispute Resolution
8.1. Any disputes arising from transactions with the Company shall be resolved through deliberation and mutual agreement.
8.2. If no agreement is reached, the matter will be submitted to the local court for resolution.
8.3. The Company reserves the right to take legal action in cases of fraud, misrepresentation, or breach of contract.
9. Privacy & Data Protection
9.1. The Company collects and processes customer information in compliance with Malaysia’s Personal Data Protection Act (PDPA).
9.2. Customer data will not be shared with third parties except as required by law or with the customer’s consent.
9.3. Customers have the right to request access, correction, or deletion of their personal data.
10. Limitation of Liability
10.1. The Company shall not be liable for any indirect, incidental, or consequential damages arising from the purchase or use of any vehicle.
10.2. The Company’s total liability shall not exceed the amount paid by the customer for the vehicle in question.
11. Governing Law
11.1. These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.
12. Amendments & Updates
12.1. The Company reserves the right to update or modify these Terms & Conditions at any time without prior notice.
12.2. Customers are encouraged to review these Terms & Conditions periodically.
By purchasing a vehicle from Fatima Corporation Sdn Bhd, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
